These abstract arguments provide a foundation for dangerous legal conclusions: that international law is largely irrelevant to determining how and when terrorists can be captured or killed; that the US President alone should be directing the War on Terror without significant input from Congress or the judiciary; that US courts should not hear lawsuits alleging violations of international law; and that the US should block any international criminal court with jurisdiction over Americans. These polemical accounts have ultimately triggered America's pernicious withdrawal from international cooperation.
In The Assault on International Law, Jens David Ohlin exposes the mistaken assumptions of these "New Realists," in particular their impoverished utilization of rational choice theory. In contrast, he provides an alternate vision of international law based on an innovative theory of human rationality. According to Ohlin, rationality requires that agents follow through on their plans and commitments even when faced with opportunities for defection, as long as the original plan was beneficial for the agent. Seen in the light of this planning theory of rational agency, international law is the product of nation-states cooperating to escape a brutish State of Nature-a result that is not only legally binding but also in each state's self-interest.

Masterful, courageous

This masterful presentation of international law as the product of rational self-interest book is highly recommended for students and lay persons concerned about the future of the United States in world affairs. Ohlin documents the provincial critique of international law by a clique of established professors once connected to the Bush administration. We knew that power corrupts. Now we learned that intelligence corrupts power. The only solution is better intelligence and powerful writing; the Ohlin book provides both.

Important Work. Must read for Civil Society Lawyers.

I originally bought based on a recommendation in one of my journals. As a lecturer in international relations and security studies, I thought it was an interesting idea. Unfortunately, the author knowledge of the literature outside of the legal and philosophical arenas was limited which resulted in missing a great deal of work that had been done by others. As an example, he spends a great deal of time making a normative argument for cooperation, yet never mentions the ground breaking work done by Robert Axelrod on cooperation starting with his 1980 experiment and THE COMPLEXITY OF COOPERATION as well as Mansbridge's work on altruism.
Similarly, his use of rational choice theory was disappointing and showed a limited view of the theory (or method). First, he defaults to prisoner's dilemma without aligning the assumptions of the model with his argument. Personally, I think that Battle of the Buddies (Sexes in the original) would be a better example of the mixed motives he says actors have. (As an aside, the solution to PD changes slightly if played in extensive form vs. normal form). a Second, he makes claims of irrationality for actions, thereby ignoring that rational actor theory looks at the goals from the perspective of the decision maker. That is why Pape can make the argument that suicide terrorism is rational. Finally, he assumes that actors are all maximizers, while game theorists such as Bueno DeMesquita, or behavioral economists like Kahneman and Tversky have shown that decision makers do not always act in that manner. Even classic game theorists such as Neumann and Morgenstern recognize that decision makers may be selecting based on loss minimization (the security solution).
Lastly, having sat or numerous thesis committees, I would have faulted this as a draft for lack of examples. Much of the argument is based on assertions or hypothetical arguments. Both would have been strengthened if real life examples were used to support his positions.
